The terms and conditions apply to the sale and delivery of goods by EMV+, Dr. Eva Vejvar, MSc, Vöglthen 24, 4713 Gallspach. Deviating conditions of the customer are only valid if we have agreed to them in writing. By placing an order, the customer agrees to these terms and conditions and is bound by them. The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. The order of the customer by clicking the button “submit order” represents an offer to conclude a purchase contract. By clicking the button “submit order” you make a binding order of the goods in the shopping cart. The subsequent automatic confirmation of the receipt of the order and any subsequent status reports will not constitute acceptance of the offer. The purchase contract is only concluded as soon as we deliver the ordered goods and confirm the shipment to the customer.

Offer and conclusion of contract

The order is made in writing by e-mail and is binding with the dispatch of the order. Write and calculation errors entitle us to resign. We have as well the right of withdrawal if the ordered product is not available. The already paid purchase price will be reimbursed immediately in these cases. Deliveries and billing are the same as the written confirmation. We reserve the right not to supply individual customers. In the case of legal transactions with consumers within the meaning of the Austrian Consumer Protection Act, these General Terms and Conditions of Business apply to the extent that they do not contradict mandatory provisions of the Consumer Protection Act.


The content of the contract, all other information, customer service, data information and complaint processing are offered in German and English.

Business customers (B2B)

The content and settings for VAT calculation of our webshop are primarily tailored to end users (B2C). If you are a business customer (B2B) within the EU and have a valid sales tax identification number, please contact us before completing the purchase so that we can issue a correct invoice.

Warranty, retention of title, liability

Until full payment of the ordered goods, the goods remain the property of EMV+, Dr. Eva Vejvar, MSc, Vöglthen 24, 4713 Gallspach. Before full payment of the goods, the customer is prohibited from pledging the goods, assigning them as security or granting third parties any rights. The warranty is limited to the statutory period of 24 months.
Occurring defects are to be announced as far as possible upon delivery or after becoming visible (without any disadvantageous legal consequences for the customer who is a consumer within the meaning of the KSchG).
In the case of legitimate defects, either a free replacement or an improvement is made, for which a reasonable period must be granted.
If the purchase is a commercial transaction (B2B) for the customer in accordance with § 1 KSCHG (377 (1) HGB), it must examine the goods immediately upon receipt and notify us immediately upon discovery of a defect.
We are not liable for damages due to incorrect cleaning and treatment of the purchased products.
Without the express consent of the seller, the customer is not entitled to remedy the defect itself directly or have it removed by a third party (self-performance); expenses incurred in this respect will not be reimbursed.

Revocation policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods. by means of a clear statement (e.g. a letter sent by post or e-mail) about your decision to withdraw from this contract. You can use the attached model revocation form, which is not mandatory.

In order to maintain the cancellation period, it is sufficient that you send the notice of the withdrawal before the expiry of the withdrawal period.

Consequences of the withdrawal
If you withdraw from this agreement, we shall reimburse you for any payments we have received from you, including delivery charges (except for the additional costs arising from your choosing a different delivery method than the most favorable standard delivery we offer), promptly and no later than fourteen days from the date on which we receive notice of your cancellation of this agreement.
For this reimbursement, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees. We may refuse to repay you until we have the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You bear the immediate costs of returning the goods. We will deduct postage for freight prepaid shipments from the amount to be refunded. You only have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functionality of the goods.

Goods made to customer specifications (made-to-measure products) and bulk goods tailored to customer requirements are excluded from the right of withdrawal.

Unsuccessful delivery or non-acceptance of the package by the recipient
An unsuccessful delivery on the part of the recipient (e.g. by specifying an incorrect delivery address) or the non-acceptance of the package by the recipient is not equivalent to a revocation. With the conclusion of the purchase contract, the payment of the corresponding shipping costs was contractually agreed between the two contracting parties, so that we have a contractual claim against you as a consumer for the payment of the shipping costs, which will be invoiced in any case.

If we have offered shipping free of charge, we are entitled to compensation, which covers the shipping costs. To do this, however, you as the consumer must have deliberately or at least negligently caused the non-acceptance, whereby you as the consumer must demonstrate that you are not at fault.

As a result of an unsuccessful delivery or a non-acceptance by the recipient, we contact you as a consumer by email or, if necessary, by telephone to agree further steps.

You can visit our site without giving any personal information. We only store access data without personal reference. These data are evaluated solely for the purpose of improving our offer and do not allow any conclusion on your person.

Errors and misprints are reserved, as well as color deviations of the Internet presentations.
In accordance with statutory provisions, the customer initially has only a right to supplementary performance in the event of defects in the delivered goods. The consumer has the choice of whether the subsequent performance is to be done by repair or replacement; however, the seller is entitled to refuse the type of remedy chosen, if it is possible only at disproportionate cost and the other type of remedy remains without significant disadvantages for the consumer. To companies, the seller for defects in the goods initially by its own choice warranty by repair or replacement, as far as this is possible.


The contracting parties agree, as far as no compelling legal provisions preclude, the application of Austrian law. If the contracting party is a consumer, the mandatory provisions of the law of the country in which he has his habitual residence shall apply to this contract. For disputes arising from the contract, if the contractor is an entrepreneur, our registered office is the place of jurisdiction. If the contract partner is a consumer, he can sue for EMV+, Dr. Eva Vejvar, MSc either in Austria or in the courts of the contracting state in whose territory he is a resident. If the contracting party was domiciled or habitually resident in Austria at the time of conclusion of the contract, actions of the contracting party against EMV+, Dr. Eva Vejvar, MSc will be charged only in Austrian courts.

Dispute settlement

The European Commission provides a platform for online dispute settlement, which you can find at https://ec.europa.eu/consumers/odr. We do not participate in a dispute settlement procedure in a consumer arbitration board.
